AWAREPA DATING SERVICE Site Policies This Service Agreement was last updated August 1st, 2007. Awarepa Dating Service ™ lets you connect with other singles any time, day or night, by phone or right here on the net. When you use our service (the Site), you must agree to the following terms and conditions. The Agreement By using the you agree to be bound by this Agreement, including all amendments made to date. The terms of this Agreement may be changed, services discontinued or altered from time to time. Any modifications to the Agreement become effective upon posting the revised agreement. It is your responsibility to stay informed of any changes to this Agreement. Your continued use of the Site indicates your agreement to these terms. If you do not agree, you must discontinue use of the Site and any features/services in connection with the Site. The Service Awarepa Dating Service Network provides online information, entertainment, and communication services on the personals network (www.awarepa.com) and through other products/features on the Internet. For the purposes of this Agreement, a "User" is defined as an individual who uses the Site either as a Guest or Member. Guests are allowed access to fewer site features. Members are required to create an account on the Site and provide some personal information. Members have greater access to the features of the Site, but may be required to pay fees in order to enjoy complete access to all features. Members will be informed when a Site feature requires payment prior to using the feature. No cost will be incurred before the Member agrees to incur such cost. Members from time to time will be contacted as it pertains to the use of the service and for promotional information or participation in promotions. In using the service, you agree and opt into receiving information from Awarepa Dating Service. Your agreement and participation to these terms is acknowledged when you check the "Yes, I am over 21 and have read and agree to Awarepa Dating Service™" checkbox when you signed-up to use the service. Adult You must be (21) years of age or over to use the Site. Membership on the Site is void where prohibited. By using the Site, you represent, warrant, and covenant that you have the right, authority, and capacity to enter into this Agreement and to abide by all the terms and conditions of this Agreement. Site Use The Site is for the express personal use of individuals only and may not be used in connection with any commercial endeavors. Organizations, companies, and/or businesses may not become Members and should not use the Site for any purpose. Illegal and/or unauthorized uses of the Site, including the collection of Member names, data and/or email addresses of Members by electronic or other means for the purpose of sending unsolicited email or otherwise is strictly prohibited. Unauthorized framing of the Site will be investigated and appropriate legal action will be taken, including without limitation, civil, criminal, and injunctive legal action. Proprietary Rights Awarepa Dating Service! owns and retains all proprietary rights in the Site. The Site contains the copyrighted material, trademarks, and other proprietary information of Awarepa Dating Service!and its licensors. Information, including content, distributed or posted by Awarepa Dating Service!, our partners, or Members may be protected whether or not it is identified as proprietary to any of the aforementioned parties You agree not to modify, copy, or distribute any such information in any manner whatsoever without having first received the express written permission of the owner of such information. Except for information that is in the public domain or for which you have been given written permission, you may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information. Site Rights Your right to use the Site is subject to any limitations, conditions, and restrictions set by Awarepa Dating Service! from time to time. Awarepa Dating Service! reserves the right to alter, suspend, or discontinue any aspect of the Site at any time, including the availability of any Site feature, database, or content. Awarepa Dating Service! reserves the right to monitor all messages, advertisements and public postings to ensure that they conform to the guidelines as set out in this Agreement. Awarepa Dating Service! may also impose limitations on features and aspects of the Site that may include restrictions to parts or to the entire Site without notice or liability. You may not use the Site for any unlawful purpose. Awarepa Dating Service! reserves the right to refuse to grant you membership or to grant you an Account Name, defined as the name that a member uses to sign into the Site, or Profile Name, defined as the name that a member uses to be identified on the Site, that impersonates someone else, is protected by trademark or intellectual property law, or is vulgar or otherwise offensive, as determined at the sole discretion of Awarepa Dating Service!. Site Content You understand and agree that Awarepa Dating Service! may review and delete any content, messages, photos, or profiles (collectively, the "Content") that, in the sole discretion of Awarepa Dating Service!, violate this Agreement or which might be offensive, illegal, or that might violate the rights, harm, or threaten the safety of other Members. You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Site, or transmit to other Members. In your Profile, you may not include any self-identifying information such as telephone numbers, street addresses, real names, URLs, or email addresses. By posting Content to any public area of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to Awarepa Dating Service ! an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display, and distribute such information, including the Content and to prepare derivative works of, or incorporate into other works, such information, including the Content, and to grant and authorize sublicenses of the foregoing. Awarepa Dating Service! reserves the right, but is not obligated, to delete, move, or edit the Content, including without limitation, any messages, profiles, or public postings, that Awarepa Dating Service!, in its sole discretion, deems to violate the Site or Content guidelines set out in this Agreement, or to be otherwise unacceptable. Conduct Awarepa Dating Service! reserves the right to investigate and take appropriate action, at its sole discretion, against any person who violates the provisions herein with respect to illegal or prohibited subject matter in the Content. Such action shall include removing the offending communication from the Site, terminating the membership of such violators, or taking appropriate legal action. On the site, it is illegal or prohibited to: 1. post, upload, store, message, or transmit in any form:
2. impersonate, falsely state, or otherwise misrepresent an affiliation with a person or entity. 3. act in a manner that negatively affects other Members' ability to engage in real-time exchanges. 4. not keep all information provided to you through the Site as private and confidential except when distribution of any information obtained through the Site is with the expressed permission of the person who provided it to you. 5. gain access to areas that are private without the expressed consent or permission of Awarepa Dating Service!, and/or Members where applicable. 6. interfere with or disrupt the website or servers or networks connected to the site that might cause harm to the Site or to other Members' systems in any way. 7. violate any applicable local, state, provincial, national, or international law or any regulation having the force of law. 8. harass another Member (whether on or off the Site). 9. involve minors in any way — including, without limitation, to establish unlawful contact with minors (whether on or off the Site). 10. collect or harvest screen names; collect or store personal data about other members; or solicit or attempt to discover a member's password, screen name, or other registration information without the member's express knowledge and consent. 11. engage in activities without expressed permission from Awarepa Dating Service! such as running raffles, lotteries, or contests. 12. store any information or use any Web page or directory for remote loading or as a door or signpost to another Web page, whether inside or outside the Site; and. 13. promote or provide instructions of information about how to engage in illegal conduct or commit illegal activities, promote physical harm or injury, or promote any illegal act. Privacy Policy Awarepa Dating Service! we respect the privacy of our members and those who enter our contests and promotions. As part of our commitment to you, and in our on-going endeavor to protect our Member's privacy, we want to clarify why we may ask you for your personal information (such as your name, address and email/phone number). Our Privacy Policy can be accessed from the main page (where Members sign in) of the Site and on every page of the Site. In having an account or community profile within the Awarepa Dating Service! Network you agree and opt into receiving information from Awarepa Dating Service! in providing you service and for informing or entering you into promotions and contests.Awarepa Dating Service!, in providing members promotions and contests, may have no direct or indirect relationship, or affiliation with the company or corporation administering the promotions and contests, |except where the prize consists of a gift certificate for use on the internet address within Awarepa Dating Service! Network, Members should review the terms and rules of such promotions and contests for complete details about their participation and terms of participation. Members will not hold Awarepa Dating Service liable for any damages, warranties or liability resulting from participating in any promotions or contests. If you are a member, we collect personal information in order to set up an account/membership and to provide you with exemplary ongoing service. For example, we collect information that allows us to process your account/membership, confirm your identity and email/phone number so that we can assist you knowing that you are who you say you are. Awarepa Dating Service reserves the right to send electronic mail to you for the purpose of informing you of changes or additions to the Site from time to time. For this reason, we require that you enter your email address when you become a Member. Your information is strictly confidential and is stored to prevent improper access. Personal information that we collect assists us in ensuring that only you and only you have access to your account/membership or personal information. Be assured, Awarepa Dating Service will not sell, lend, or otherwise distribute your email address to external/third parties unless we have your express consent. We may contact you to conduct surveys or determine your preferences in order to better serve you and provide you with the service that you wish to receive. If you enter a contest or participate in a promotion, we collect personal information to process your entry and administer the contest/promotion. Fees At this moment as of today August 1st 2007, there is no charge for the use of the site. The services we provide to you is free of charge and there is no monetary charges involved. Members will be notified in case the management decide to do so. Awarepa Dating Service reserves the right at any time to charge, change, or waive fees for access to the Site or for services and features on the Site. You will never be charged a fee on the Site unless you agree to incur such cost. Once you have agreed to incur such a cost and have purchased a subscription using a credit card, your subscription will be renewed automatically for the period you originally purchased, no sooner than two days prior to your paid-through date. This ensures uninterrupted access to your subscription. You may resign your subscription at anytime. Simply sign in and select Cancel Subscription in My Account under the About Me section. Charges will appear on your bill as Awarepa Dating Service Group. All sales are final. If you do not consent to fees where required, you may not have access to some Content, services, and features. No Warranties, No Responsibility You acknowledge without limitation that: 1. Awarepa Dating Service is not responsible for any incorrect or inaccurate Content posted on, or in connection with, the Site, whether caused by Members or by any of the equipment or programming associated with or utilized in the Site. 2. Awarepa Dating Service is not responsible for the conduct, whether online or offline, of any Member. 3. Awarepa Dating Service assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, or unauthorized access to, or alteration of, Member communications. 4. Awarepa Dating Service is not responsible for suspension or interruption of the Site and its features, regardless of the cause. 5. Awarepa Dating Service is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Members or to any other person's computer related to or resulting from participating or downloading materials in connection with the Site and/or in connection with the Site. Under no circumstances will Awarepa Dating Service be responsible for any loss or damage, including personal injury or death, resulting from anyone's use of the Site, any Content posted on the Site or transmitted to Members, or any interactions between Members, whether online or offline. The Site is provided on an "as is" basis and Awarepa Dating Service expressly disclaims any warranty of fitness for a particular purpose or non-infringement. Awarepa Dating Service cannot guarantee and does not promise any specific results from use of the Site. You acknowledge that the use of the Site is at your own risk. Awarepa Dating Service does not represent or endorse the accuracy or reliability of any content supplied by Members of the Site. Awarepa Dating Service may discontinue or change the Site and its features or its availability to you at any time, without notice, and you may stop using the Site at any time. Your continued use of the Site or following the posting of notice of any changes in this Agreement will constitute a binding acceptance by you of this Agreement and any subsequent modifications. Limitation on Liability Except in jurisdictions where such provisions are restricted, in no event will Awarepa Dating Service be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages, including also lost profits arising from your use of the Site, even if Awarepa Dating Service has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Awarepa Dating Service's liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Awarepa Dating Service for the Site during the term of membership. You acknowledge that: 1. Awarepa Dating Service cannot ensure the security or privacy of information you provide through the Internet and/or your email service, and you release us from any and all liability in connection with the use of such information by other parties. 2. Awarepa Dating Service is not responsible for and cannot control the use by others any information that you provide to them and you should use caution in selecting the personal information you provide to others through the Site. 3. Awarepa Dating Service cannot assume any responsibility for the content of messages sent to you on the Site, and you release us from any and all liability in connection with the contents of any communications you may receive from others. You acknowledge that your account is private and should not be used by anyone else. You are responsible for all usage or activity on the Site by individuals using your password, including but not limited to, the use of your password by any third party. Indemnity You agree to indemnify and hold Awarepa Dating Service, its subsidiaries, affiliates, officers, directors, agents, and other partners and employees, harmless from any loss, liability, claim, or demand, including reasonable legal fees, made by any third party due to, or arising out of, your use of the Site in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above. You shall cooperate fully as reasonably required in the defense of any claim. Awarepa Dating Service reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, provided, however, that you shall remain liable for any such claim. External Links The Site may post from time to time links to other Internet sites and resources. Awarepa Dating Service is not responsible for the privacy policies of those sites or the cookies those sites use. In addition, because Awarepa Dating Service has no control over such sites and resources, you acknowledge and agree that Awarepa Dating Service is not responsible for the availability of such external resources, and does not endorse and is not responsible or liable for any content, advertising, products, services, or other materials on or available from such sites or resources. Prior to use of these sites, it is recommended that you review the site's terms of use/service agreements and privacy policy. Governing Law This Agreement is entered into effect in the province of Ontario, Canada. You agree that the laws of the province of Ontario will govern it and any disputes arising out of this Agreement will be subject to the courts of the province of Ontario and the federal courts applicable within the province. If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect. The United Nations Convention on Contracts for the International Sale of Goods will not govern this Agreement. Awarepa Dating Service reserves the right to assign this Agreement or our rights to a service, and if Awarepa Dating Service does so, it is relieved of any liability. Termination of Membership This Agreement remains in effect while you use the Site and/or are a Member. You may terminate your membership at any time for any reason by sending an email notice of termination to help@Awarepa Dating Service or by using the Cancel My Account feature located in the My Account area of the Site. We may, at our sole discretion, terminate or suspend your membership at any time, with or without notice, for any reason including, without limitation, breach of this Agreement. Where notice is given, termination is effective immediately upon sending notice to you at the email address you provided in your registration for membership, or such other email address as you may later provide to Awarepa Dating Service. If Awarepa Dating Service terminates your membership because you have breached the Agreement, you will not be entitled to any compensation or refund of any applicable fees or payments. Even after membership is terminated, this Agreement will remain in full force and effect. Without limiting the generality of the foregoing, any fraudulent, abusive, or otherwise illegal activity, or that which may otherwise affect or damage the Site or Site membership may be grounds for termination of your membership and/or access to all or part of the Site at Awarepa Dating Service's sole discretion, and you may be referred to appropriate law enforcement agencies. General This Agreement contains the final statement of the understanding between you and Awarepa Dating Service with respect to, and supercedes any and all prior or contemporaneous negotiations, agreements, or communications, whether written or oral, between you and Awarepa Dating Service concerning the subject matter of this Agreement. The waiver by Awarepa Dating Service of a breach or default of any of the provisions of this Agreement by you shall not be construed as a waiver of any succeeding breach of the same or other provisions; nor shall any delay or omission on the part of Awarepa Dating Service to exercise or avail itself of any right, power, or privilege that it has or may have hereunder operate as a waiver of any breach or default by you. The section titles in this Agreement are solely used for convenience and have no legal or contractual significance. Awarepa Dating Service reserves the right to update and modify this Agreement from time to time. Notification of changes to the Agreement will be posted on the Site or sent via electronic mail to you at the address provided upon registration or an alternative email address subsequent to registration on the Site which you have provided to Awarepa Dating Service to use for direct communication including, but not limited to, modifications to the Agreement. If you do not agree to any modifications, you should terminate your use of the Site. Your continued use of the Site now, or following the posting of notice of any changes in this Agreement, will constitute a binding acceptance by you of this Agreement, or any subsequent modifications. |
